JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
Petitioner No. 1 is the son-in-law of the informant, whereas Petitioner No. 2 is elder brother of Petitioner No. 1. The second daughter is alleged to have been kidnapped for the purpose of marriage by the accused persons.
Learned counsel for the petitioners submits that even in the case diary, wife of Petitioner No. 1, who is the daughter of the informant, has not supported the allegation made
Patna High Court Cr.Misc. No.13162 of 2015 (4) dt.23-07-2015 2/2 in the First Information Report. He has also relied upon an order of this Court dated 04.02.2015 by which other co-accused namely Sipahi Singh has been granted the privilege of anticipatory bail. In view of the submission as above, let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran in connection with Sugauli P.S. Case No. 317 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
