KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 17-10-2022 Petitioner has prayed for the following relief(s):- "That this is an application for issuance of an appropriate writ(s), order(s), direction(s) for quashing the order contained in Memo No 6177 dated 31.08.2018 by which the petitioner has been black listed for a period of 10 years under Rule, 11 (A) (VII) of the Bihar Constructions Registration Rules 2007 on the allegation of submitting a false bank guarantee which is totally misconceived and false and further for a direction to permit him to participated in any tender and further for any other reliefs for which petitioner may found entitled in accordance with law."

After the matter was heard for some time, finding

Patna High Court CWJC No.3998 of 2019(3) dt.17-10-2022 2/2 the Court not in favour of the submissions made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petitioner is permitted to withdraw the present petition, with liberty to initiate appropriate proceedings before the appropriate forum and to take recourse to such other alternate remedies which are equally efficacious in law. Prayer allowed.

The petition is disposed of as withdrawn with the liberty aforesaid.

Liberty reserved to the petitioner to take recourse to such other remedies as are otherwise available in accordance with law.

It stands clarified that all issues of fact and law are left open to be agitated by the competent authority. Interlocutory application(s), if any, shall also stand disposed of.
