2. The petitioner seeks bail in connection with Pathkhauli P.S. Case No. 74 of 2025 registered for the offence under Sections 338, 336(3), 303(2), 317(2), 316(2), 318(4), 61(2), 3(5) of the BNS, under Section 21 of MMDR Act, and under Section 11, 43, 56 of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019.

3. As per the prosecution case, the allegation against the accused persons is that they have got the vehicle released on the basis of forged documents.

4. The petitioner is in custody since 13.08.2025 and

No.15759 of 2026(2) dt.03-04-2026 2/2 it has been submitted by the learned counsel for the petitioner that the petitioner is the driver of the vehicle in question and the petitioner has falsely been implicated in this case. He further submits that in the entire penalty amount has been paid by the owners of the vehicle and they have already been granted bail vide order dated 19.02.2026 passed in Cr. Misc. No. 51237 of 2025.

5. Considering the facts of the case and also considering the fact that the entire amount of fine i.e. Rs. 4,70,000/- has been deposited with the concerned department, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Bagaha/concerned Court below in connection with Pathkhauli P.S.
