Petitioner is accused in connection with Bihiya P.S. Case No. 115 of 2014 registered under Section 395 of the I.P.C. Learned counsel for the petitioner submits that petitioner is not named in the first information report. He has been implicated in this case on confessional statement of co-accused. Petitioner has not been put on Test Identification Parade as yet. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 11.12.2016. Similarly situated co-accused has been granted bail by this Court vide order dated 19.01.2016 passed in Cr. Misc. No. 57627 of 2015. Having considered the facts and circumstances of the

Case No. 115 of 2014.
