JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of regular bail for offence under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

From the motorcycle of the petitioner 11.04 Kg of ganja or charas like substance was recovered by the police. Submission of the learned counsel for the petitioner is that the petitioner is ready to cooperate with the trial. The investigation is already complete. However, there is no forensic report as to whether the recovered articles were really narcotic drug or not. The seizure list does not reveal that what type of article was seized by the police. The petitioner has stated on oath that he has got no criminal antecedent and is in jail since 30.12.2016.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like

Patna High Court Cr.Misc. No.17301 of 2017 (3) dt.20-06-2017 2/2 amount each in connection with Shikarpur P.S. Case No. 555 of 2016 to the satisfaction of the Sessions Judge, West Champaran at Bettiah, or successor Court with the condition that the petitioner shall fully cooperate with the trial of the case, failing which the bail bond of the petitioner shall be cancelled by the Court below itself.
