====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 20-10-2020 Heard the parties in Virtual Court.

The petitioner is languishing in custody for the offence punishable under Section 376 of the Indian Penal Code. Petitioner allegedly ravished to the informant. He is in custody since 06.11.2018.

Earlier prayer for bail was refused on 15.05.2019 vide order at Annexure-1.

The report of the trial Judge reveals that charges have already been framed on 25.09.2019, however no prosecution witness has turned up uptill now.

Learned counsel for the petitioner submits that the informant is agnate and for land dispute false case has been levelled. She is aware of the pending trial, however no one is appearing on behalf of her before the Court.

No.9826 of 2020(3) dt.20-10-2020 2/2 Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No. 242/2019 arising out of Barhara P.S. Case No. 145 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
