2. The petitioner is apprehending his arrest in connection with Kawakol P.S. Case No. 215 of 2024 for the offence punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code, lodged on 29.06.2024 by the informant Samuntri Dev.
3. As per the prosecution story, the informant alleged that the accused side assaulted the number of family members and allegation against this petitioner is of giving axe blow on the head of Manoj Chauhan while he as also Sajjan Chauhan assaulted the mother-in-law again causing head injury. When the husband came to rescue, the petitioner assaulted him also. This led to the F.I.R.
4. Learned counsel for the petitioner submits that both
Patna High Court CR. MISC. No.12578 of 2025(3) dt.14-05-2025 2/2 are agnates, there is case and counter case, both sides suffered injuries and he do not have criminal antecedent.
5. Learned APP Mr. Bharat Bhushan on the other hand has taken this Court to the injury of Manoj Chauhan to show that it has been found to be grievous in nature. He further submits that beside Manoj Chauhan allegation of assaulting the mother-in-law and husband are also on this petitioner.
6. Considering the allegation that has come against this petitioner coupled with the fact that the injury has been found to be grievous in nature, no relief can be granted to the petitioner.
