JUSTICE MIHIR KUMAR JHA ORAL ORDER 12-03-2015 Having regard to the fact that no part of cause of action of has arisen within the territorial jurisdiction of this Court, inasmuch as, the advertisement, in question, was issued from Bhubneshwar, the selection was made at Bhubneshwar, this writ application, only because an order passed at Bhubneshwar has been communicated to the petitioner at Gaya will not mean that the writ application will be maintainable before this Court. This aspect of the matter has already been decided by the judgment of this Court in the case of Amar Kumar Choubey Vs. The Union of India & Ors. reported in 2009(1)PLJR 553.

When such an observation has been made, learned counsel for the petitioner seeks permission to withdraw this

Patna High Court CWJC No.3539 of 2015 (2) dt.12-03-2015 application in order to enable the petitoiner to move competent court.

This application is accordingly permitted to be withdrawn with the aforementioned liberty.
