JUSTICE SANJAY PRIYA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Kadwa P.S. Case No. 321 of 2016 instituted for the offence under Section(s) 30(a), 37(a) of the Bihar Excise (Amendment) Act.

In the written report, it is alleged that 333 litres of foreign liquor has been recovered from the Scorpio vehicle which was driven by this petitioner and two persons namely Kishan Yadav and Anil Kumar Thakur were sitting in the aforesaid vehicle.

It has been submitted by learned counsel for the petitioner that co-accused Kishan Yadav has already been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 12052

Patna High Court Cr.Misc. No.8742 of 2017 (3) dt.20-04-2017 2/2 of 2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Katihar in connection with Kadwa P.S. Case No. 321 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
