JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-02-2016 The present application has been filed for modification of the order dated 08.10.2014 passed in Cr. Revision No. 350 of 2012 to the extent that some time limits fixed for disposal of application under Section 127 Cr. P.C. pending before the learned court below. Opposite party no.2 preferred Cr. Revision No. 350 of 2012 before this Court against the order dated 17.06.2011 passed by learned Principal Judge, Family Court, Purnea in Case No. M-52 of 1988 whereby amount of maintenance has been enhanced from `1,000/- to `5,000/- per month from the date of order i.e., 17.06.2011. The petitioner was directed to make payment of maintenance amount by 18th day of every succeeding month. The opposite party no.2 claimed further enhancement of maintenance amount of `5,000/- to `8,000/- per month as well as for a direction to make payment of arrears of maintenance amount. This Court after hearing counsel for the parties, disposed of

Patna High Court Cr.Misc. No.7213 of 2016 (2) dt.17-02-2016 2/2 criminal revision application with direction to the opposite party no.2 to make payment of arrears of maintenance amount, if any, within a period of three months and to make payment of maintenance amount regularly as directed by the learned court below. It was further observed that it is expected from the learned court below to decide the application of opposite party no.2 filed under Section 127 of the Cr. P.C.

It is submitted by learned counsel for the petitioner that application filed under Section 127 Cr. P.C. has not been disposed of till date.

There is nothing on record to suggest that any prayer was made before the learned court below for disposal of the application under Section 127 Cr. P.C.

It is expected from the learned court below to dispose of the application under Section 127 Cr. P.C. preferably within a period of two months from the date of receipt/production of the copy of this order.

Accordingly, the present modification application is disposed of.
