JUSTICE SANDEEP KUMAR ORAL ORDER 15-07-2026 Heard the learned counsel for the petitioner, the learned APP for the State and the learned counsel for the O.P. No. 2.
2. The present application has been filed for cancellation of the anticipatory bail granted to O.P. No. 2 by the learned Additional Sessions Judge-III, Vaishali at Hajipur, vide A.B.P. No. 3308 of 2025, arising out of Complaint Case No. 3520 of 2023, registered under Sections 323, 504, 406, and 420 of the Indian Penal Code.
3. It is the contention of learned counsel for the petitioner that the privilege of anticipatory bail was granted to
Patna High Court CR. MISC. No.14789 of 2026(3) dt.15-07-2026 2/2 O.P. No. 2 without issuing any notice to the petitioner and without affording him an opportunity of being heard.
4. In view of the aforesaid submission, the present application is disposed of with liberty to the petitioner to approach the learned Court below itself by filing an appropriate application for cancellation of the bail granted to O.P. No. 2 on the grounds taken in the present application.
5. In the event any such application is filed, the same shall be considered and disposed of by the learned court below in accordance with law within a period of one month from the date of its filing.
