The petitioner seeks bail in a case registered under Sections 414, 419, 420, 467, 468, 471 of the Indian Penal Code. Allegation is that some unknown ciber criminals have assembled near State Bank ATM at Majhagarh. The police proceeded at the aforesaid ATM and the petitioner was arrested and recovered Debit card of different Bank from the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.1.2020 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Fake ATM card is said to have been recovered. The petitioner had no knowledge that the ATM card

Patna High Court CR. MISC. No.15289 of 2020(2) dt.03-03-2020 2/2 is fake. The petitioner has been made accused due to mistake of fact.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Majhagarh P.S. case No.01 of 2020.
