JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-02-2019 The petitioners seek bail in anticipation of their arrest in connection with Bounsi P.S. Case No. 18 of 2016 dated 18.02.2016 instituted for the offences under Sections 147, 149, 323, 337, 308, 504, 506, 34 of the Indian Penal Code.

The petitioners are alleged to have indulged in brick-batting leading to one simple injury on the person of the husband of the informant.

The allegation against the petitioners is general and

Patna High Court CR. MISC. No.11717 of 2019(2) dt.26-02-2019 2/2 omnibus and nothing specific has been attributed to anyone of the petitioners. There is a counter version of the occurrence as well. The learned counsel for the petitioners has submitted that the F.I.R has been lodged because of the past enmity over the land on which the parties have competing claims.

Regard being had to the aforesaid facts and clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No. 18 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
