2. The present application is being filed for modification of the order dated 01.08.2022 passed in Cr. Misc. No. 3389 of 2022 by this Bench, whereby a direction was given to the petitioner that he will surrender before the Court below within a period of four weeks from the date of receipt/production of the order.
3. It is submitted by learned counsel for the petitioner that the petitioner has not misused the privilege of bail deliberately, petitioner was unable to furnish the bail bond within the given time period because he lives in another state for
Patna High Court CR. MISC. No.494 of 2024(2) dt.05-01-2024 2/2 the work, at the time of announcement of the order, he was out of station.
4. It is a case of not furnishing the bail bond within time by the petitioner.
5. There is a glaring mistake and willful intention of the petitioner and he was not able to furnish the bail bond within the given period of time.
6. Having heard the learned counsel for the parties and considering the fact and circumstances of the case, this court is not allow this modification application for grant of extension of time for furnishing the bail bond.
7. Accordingly, this modification application stands rejected.
