2. The petitioners seek bail in connection with Dhaka P.S. Case No. 551 of 2025 instituted for the offences under Sections 126(1), 115(1), 118(2), 109(1), 74 and 3(5) of the Bharatiya Nyaya Sanhita.
3. The allegation is that the husband of the informant was assaulted by five persons. The allegation against the petitioner is of assaulting on his head and the allegation against Munaf Alam is of assaulting on his mouth. The injury report of the informant's husband on record where he said to have sustained grievous injury on his nose.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners are in custody since 12.10.2025
Patna High Court CR. MISC. No.11561 of 2026(4) dt.05-05-2026 2/2 and have got no criminal antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case, clean antecedents of the petitioners and the period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikarhana at Dhaka, East Champaran/concerned Court in connection with Dhaka P.S. Case No. 551 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
