====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 01-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Kudhni (Fakuli O.P.) P.S. Case No. 478 of 2022 registered for the offence under Sections 302 and 120B of the I.P.C. The prosecution case, in brief, is that the petitioner alongwith other F.I.R. named accused persons after hatching conspiracy called the son of the informant, namely, Raushan Kumar (deceased) from Keral where he was doing Majdoori at Hajipur for the purpose of marriage with Anjali Kumari, daughter of accused Dasai Mahto, and thereafter all have assaulted his son and committed his murder.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.10.2022. He has got no

There is no allegation of tampering with the witnesses alleged against the petitioner. There is no chance of trial being concluded in near future. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Muzaffarpur (West), in connection with Kudhani (Fakuli O.P.) P.S. Case No. 478 of 2022.
