2. The petitioners seek bail in connection with Chand P.S. Case No. 147 of 2023 registered for the offence punishable under Sections 341, 323, 324, 325, 307, 302, 379 and 506/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are said to have assaulted the victim.

4. The main argument advanced by learned counsel for the petitioners is that the injuries have been found on nonvital part of the body and the doctor has opined that the time elapsed since death is about three to four days which points out

Patna High Court CR. MISC. No.14775 of 2024(3) dt.03-05-2024 2/2 to the fact that the deceased had died much prior to the date of occurrence. The petitioners are in jail since 28.11.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, be released on bail, after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Kaimur (Bhabua) in connection with Chand P.S. Case No. 147 of 2023, subject to the condition that the petitioners will co-operate in the trial.
