The petitioner seeks bail in a case instituted under Sections 457 and 380 of the Indian Penal Code. The prosecution story, in brief, is that the petitioner along with other co-accused was carrying the box and suitcases, after entering into the house of the informant, in the meantime, the wife of the informant raised alarm then neighbours came and accused persons fled away. Thereafter the wife of the informant inspected the house then a box and suitcase were found containing ornaments, cloths and cash of Rs. 15,000/-. The other neighbours also disclosed that some articles have also been taken away from their house.
Patna High Court Cr.Misc. No.9391 of 2017 (2) dt.16-03-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.01.2017. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no source of identification mentioned in the F.I.R. The other co-accused has been granted bail by the court below itself.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj, Rohtas at Sasaram in connection with Suryapura P.S. Case No. 20 of 2015.
