Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Durgawati P.S. Case No. 237 of 2021 instituted for the offence under Section 30(a), 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.10.2021 and charge-sheet has been submitted, is a person with clean antecedent and allegation is of recovery of 319.680 litres of liquor from a pick up vehicle in which petitioner was found sitting.

Learned counsel for the petitioner submits that petitioner was a passenger and as such not aware of the fact that was kept in the vehicle.

Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.12407 of 2022(2) dt.21-03-2022 2/2 prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and has clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.3000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Kaimur, in connection with Durgawati P.S. Case No. 237 of 2021.
