JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sour Bazar P.S. Case No. 352 of 2014 registered for the offences punishable under Sections 341, 323, 364, 354 A, 379, 504, 506/34 of the Indian Penal Code.
Although, petitioners are named in the first information report with allegation that they kidnapped, confined and assaulted the informant's husband but at the very outset, it is pointed out on behalf of the petitioners that having similar allegation, co-accused, Sadanand Sah and four others have already been admitted to anticipatory bail by a Bench of this Court vide order dated 06.01.2015 passed in Cr. Misc. No. 52095 of 2014.
Patna High Court Cr.Misc. No.5752 of 2015 (2) dt.12-02-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Sour Bazar P.S. Case No. 352 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
