2. The petitioner seeks regular bail in connection with Rupauli P.S. Case No. 135 of 2024, registered for the offence under Sections 25(1-B)a, 26/35 of the Arms Act.

3. As per prosecution case, the petitioner was caught red handed while committing loot. The villagers caught hold and handed over to the police. One country made pistol was also recovered from the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. No incriminating article has been recovered from the possession of the petitioner. Petitioner has two criminal antecedents and he is in custody since 11.09.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and also petitioner was involved in the loot, I am not inclined to grant bail to the petitioner, this application is dismissed.

7. The case of the petitioner is different from the other co-accused who has been granted bail as there was recovery of one cartridge from the co-accused.
