The petitioner seeks bail in POCSO Case No. 63/2018, arising out of Bhojpur Mahila P.S. Case No. 129/2018, instituted for offence under Section(s) 376(d) of the Indian Penal Code read with Section 6 of POCSO Act.

Learned counsel for the petitioner has submitted that the victim girl has given statement under Section 164 Cr.P.C. wherein she has not levelled specific allegation of committing illegal act with her against this petitioner. Learned counsel for the petitioner has further submitted that occurrence has taken place on 20.09.2018 and F.I.R. has been lodged on 22.09.2018, after delay of two days.

Patna High Court CR. MISC. No.14178 of 2019(6) dt.28-05-2019 2/2 He has submitted that victim has been medically examined, in which no injury has been found on her private part. Petitioner is in custody since 24.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. District & Sessions Judge, Bhojpur at Ara, in connection with POCSO Case No. 63/2018, arising out of Bhojpur Mahila P.S. Case No. 129/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
