The petitioner seeks bail in connection with Phulwarisharif (Janipur) P.S. Case No. 33 of 2017, registered under Section 302/34 of the Indian Penal Code. The allegation of informant Vijay Ray is that on 17.01.2017, he along with his wife reached at his matrimonial house then saw that his widow sister-in-law Pratima Devi (petitioner) with the help of Sujeet Kumar were pressing the neck of his mother-in-law with intention to grab the property. Thereafter, informant raised alarm then villagers reached there and petitioner and Sujeet Kumar were apprehended. Learned counsel for the petitioner submits that admittedly the petitioner is sole daughter-in-law of the deceased and she has two children as such no question arise about

Patna High Court Cr.Misc. No.17541 of 2017 (3) dt.18-05-2017 2/2 committing the murder by the petitioner of her mother-in-law Sheela Devi to grab the property. Further submission is that, in fact, at the time of occurrence, the petitioner was at the roof of house and when she came down on the ground flour then saw that her mother-in-law is dead and informant and his wife, who are brother-in-law and sister-in-law of the petitioner were present there, but with ulterior motive the petitioner has falsely been implicated in this case along with Sujeet Kumar, who is the family friend of the petitioner. Further submission is that the petitioner has no criminal antecedent is in custody since 16.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Phulwarisharif (Janipur) P.S. Case No. 33 of 2017. (Rajendra Kumar Mishra, J) manish/- U T
