JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 376/34 of the Indian Penal Code.

This is third attempt of the petitioner for grant of bail but again I am not inclined to release the petitioner on bail on the grounds mentioned by me in my previous order dated 08.10.2015 passed in Cr. Misc. No. 20436 of 2015 and hence, his prayer for bail in connection with Sessions Trial No. 196 of 2016 arising out of Bheja P.S. Case No. 25 of 2012 pending in the court of Additional Sessions Judge-VII, Madhubani stands rejected. However, learned trial court is directed to expedite

No.17891 of 2017 (2) dt.21-06-2017 2/2 the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order. It is made clear that if the trial of the petitioner is not concluded within the above stated period, the petitioner may renew his prayer for bail before the learned court below itself.

Let a copy of this order be sent to Superintendent of Police, Madhubani with direction to him to ensure the presence of informant and victim of aforesaid case before the court of Additional Sessions Judge-VII, Madhubani within three weeks from the date of receipt/production of copy of this order.
