JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of Bihar Excise (Amendment) Act, 2016.

Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 29.09.2016 passed in Cr. Misc. No. 40397 of 2016 but the petitioner challenged the order of this Court before the Hon'ble Apex Court of this country in Special Leave to Appeal (Crl.) No(s). 9856 of 2016 which was dismissed by the Hon'ble Apex Court. However, liberty was granted to the petitioner to renew his prayer for grant of bail after

Patna High Court Cr.Misc. No.7774 of 2017 (2) dt.15-03-2017 2/2 one month from the date of order of Hon'ble Apex Court. Now more than one month has already been passed and it appears from submission of the parties that up till now, trial of the petitioner could not be concluded.

Considering the period of detention of the petitioner in jail custody as well as this aspect of the matter that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Purnea Sadar (M) P.S.
