JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/14/149/448/379/504 of the Indian Penal Code. It is alleged that co-accused Suman Srivastave including petitioner broke the door of the informant and petitioner assaulted on the head of nephew of the informant with iron rod when informant and his wife came to rescue the accused also assaulted them and co-accused Pushpa snatched earring of wife of the informant.
It is submitted by learned counsel for the petitioner that for the same occurrence the petitioner's side lodged Garkha P.S. Case No.38 of 2015 and thereafter the informant lodged the present case. Injury report reflects superficial injury though
Patna High Court Cr.Misc. No.14768 of 2015 (2) dt.13-04-2015 2/2 opinion has been preserved. Petitioner's side also received injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and in the background of section 144 and 107 of Code of Criminal Procedure pending proceedings between the parties, the accusation has been levelled. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No.43 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
