Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 33, 41, 42 and 52 of the Indian Forest Act 1927 and Indian Forest (Bihar Amended Act) 1989, registered in connection with Official (Forest) Complaint Case No. 01 of 2022.

Patna High Court CR. MISC. No.12834 of 2022(2) dt.21-09-2022 2/3 The informant of this case is Forest Officer. As per allegation, a truck loaded with logs of Triwia Nudiflora trees was seized.

The learned counsel for the petitioners has submitted that petitioner no. 1 is the owner of that truck and petitioner no. 2, 3 and 4 were the driver and cleaner of the truck. Learned counsel had denied the fact that the consignment was recovered from his truck. As per paragraph no. 3 of the bail petition, the petitioners are the persons of clean antecedent. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate Sikrahana at Dhaka, East Champaran in connection with Official (Forest) Complaint Case No.

01 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C.

The petitioners shall make themselves personally available before the court below on each and every date till framing of charge.
