The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 506, 467, 468 and 471 of the Indian Penal Code. It is alleged that the petitioner persuaded the informant to deposit money in a Non-Banking Financial Company with assurance that 12% interest would be paid. It is submitted by the learned counsel for the petitioner that the petitioner being an agent of registered financial company persuaded the informant and money was deposited in the financial company and the total investment of the informant was Rs. 27,800/-. Though the informant invested in the said financial company in 2011 prior to the alleged persuasion by the petitioner. It is further submitted

Patna High Court Cr.Misc. No.6874 of 2015 (2) dt.20-02-2015 that the company has not been made party.

It is submitted by the learned counsel for the informant that the petitioner undertook to return the invested money if the financial company fails to do so. It is further submitted that the petitioner has cheated about 18 other persons.

Considering the fact that admittedly the money was invested in the Company and the Company has not been made accused, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 282 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
