The petitioner is languishing in custody for the offences punishable under Sections 302/201/120B of the Indian Penal Code.

The petitioner is suspected to have committed murder of the brother of the informant for the reason that the deceased had some affair with the daughter of one of the accused. Suspicion is based for the reason that the informant saw the FIR named five persons and some other unknown dragging the dead-body of her brother.

Submission is that the petitioner has no criminal antecedent. He is in custody since 17.11.2018. Co-accused

Patna High Court CR. MISC. No.13702 of 2019(3) dt.10-05-2019 2/2 Saguni Devi has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.77 of 2019.

Learned counsel for the informant opposed the prayer for bail.

Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Baikunthpur P.S. Case No.285 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
