The petitioner seeks bail in connection with Bariyarpur P.S. Case No.16/17 registered under Section 30(a) of Bihar Prohibition and Excise Act,2016.

The accusation is of recovery of 48 bottles each containing 750 ml, and 96 bottles each containing 180 ml. India made foreign liquor in five bags near railway Gumty in front of the shop of Satish Mandal from whom the petitioner started to flee away.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is in custody since 9.2.2017 Having regard to the facts and circumstances of the
