This application for regular bail arises out of Sadar P.S. Case No. 290 of 2019, disclosing the offences under Sections 272, 273/34 of the Indian Penal Code, Sections 30(a), and 38(2) of the Bihar Prohibition & Excise Act, 2016. It is submitted on behalf of the petitioner that it is evident from the First Information Report and the seizure memo that the recovery of illicit liquor was made from the house of coaccused Md. Iliyas. He contends that the petitioner's name has transpired on the basis of certain disclosures made by the villagers. The person from whose house the alleged illicit liquor

Patna High Court CR. MISC. No.10310 of 2020(3) dt.19-03-2020 2/2 was recovered, has been allowed regular bail by this Court by an order dated 29.02.2020 passed in Cr. Misc. 11208 of 2020. Considering the above submission, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzafarpur, in connection with Sadar P.S. Case No. 290 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
