The petitioner no. 1 being husband of the victim and petitioner nos. 2 to 5 being parents, brother and brother's wife of the husband of the victim are apprehending arrest in a case registered for the offences punishable under section 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after six years of marriage for non fulfillment of

Patna High Court Cr.Misc. No.12437 of 2015 (2) dt.25-03-2015 2/3 dowry demands.

This is not in dispute that the victim went traceless on 11.2.2014 and till date she has not been recovered. It is submitted by learned counsel for the petitioners that Sanaha was lodged vide Sanaha Diary Entry No. 365 of 2014 dated 11.2.2014 relating to missing of the victim and thereafter on 24.2.2014 the present FIR was registered by the brother of the victim maliciously.

Considering the aforesaid facts, let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case the petitioner no. 1 surrenders within six weeks from today in connection with Chapra Town P.S. Case No. 79 of 2014 pending in the court of learned C.J.M., Saran at Chapra. Considering the suspicious nature of accusation and the fact that bonafide of the accused gets reflected from the lodging of Sanaha immediately after the victim went traceless, let the above named petitioner nos. 2 to 5 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
