The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 306, 120B and 34 of the Indian Penal Code.

As per the prosecution case, on an objectionable video of the grand daughter of the informant having been made viral by the Aman Kumar @ Aman Raj, the grand daughter of the informant committed suicide and thus the F.I.R. It is submitted by learned counsel for the petitioner that the petitioner was not named in the F.I.R., the main allegation is against Aman Kumar @ Aman Raj. It is further submitted that the name of the petitioner transpired in course of

Patna High Court CR. MISC. No.21681 of 2021(2) dt.24-09-2021 2/2 investigation from the statement of coaccused Amit Kumar Raut made before the police. The said Amit Kumar Raut has been enlarged in bail vide order dated 3.7.2020 (Annexure-2) passed in Cr.Misc. no.20560 of 2020. The statement made before the police is inadmissible. The petitioner is in custody since 22.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, grant of bail to coaccused Amit Kumar Raut on whose statement before the police name of the petitioner transpired together with the petitioner having remained in custody for 9 months, this Court directs the petitioner to be enlarged on bail in connection with Dalsingsarai P.S. case no. 31 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO Act, Samastipur.
