JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant. . The petitioner, who is in custody, seeks bail in connection with Bhabua P.S.Case No. 55 of 2014 registered under Sections 420, 467, 468, 471 and 120B of the Indian penal Code. Allegation in brief is that this petitioner purchased a piece of land from one Dhawani Agrawal, who is said to be not the titleholder of the sold land.

Submission is that the petitioner is the purchaser of the land and a title suit is also going on between the vendor of this petitioner and the other claimants of the land and it is a case of civil nature and this petitioner is in custody since 02.02.2017 and other co-accused persons, namely, Rajendra Singh and Arjun

Patna High Court Cr.Misc. No.9287 of 2017 (2) dt.23-02-2017 2/2 Kumar Yadav, having their case on similar footing, admitted to bail by a co-ordinate Bench of this Court vide order dated 04.01.2016 and 20.09.2016 passed in Cr. Misc. No. 57984 of 2015 and Cr. Misc. No. 32484 of 2016 respectively. Having considered the aforesaid facts and circumstances, the petitioner, namely Birendra Bind @ Birendra Kumar Bind, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua(Kaimur) in connection with Bhabua P.S. Case No. 55 of 2014.
