The petitioner seeks bail in Dandkhora P.S. Case No. 77 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, on 04.08.2020 while the informant was going on his motorcycle to Dandkhora, on the way, three miscreants riding on motorcycle intercepted the informant and on the point of pistol snatched bag containing cash as well as mobile and fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner surfaced in this case during course of investigation. No looted article has been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Katihar in connection with Dandkhora P.S. Case No. 77 of 2020.
