JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-04-2021 The present petition has been filed for restoring a writ petition bearing CWJC No 3159 of 2016, which had stood dismissed on account of non-prosecution by an order dated 24.09.2018 passed in CWJC No. 3159 of 2016.
The learned counsel for the petitioner has submitted that on account of unforeseen events, he could not appear when the case was called out for hearing, hence the writ petition had stood dismissed on account of non-prosecution. Having regard to the facts and circumstances of the case and the submissions made by the learned counsel for the
Patna High Court MJC No.4710 of 2018(710) dt.07-04-2021 2/2 petitioner as also considering the averments made in the present petition, the aforesaid writ petition bearing CWJC No. 3153 of 2016 is restored to its original file.
