The petitioner apprehends arrest in a case registered for the offence punishable under sections 498A/120B/34 of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.

It is a case of dowry death. Petitioner is the husband of the deceased.

Learned counsel appearing for the petitioner submits that the present case is an abuse and misuse of criminal justice delivery system as for the same occurrence, complainant had also filed Kutumba Police Station Case No. 101 of 2014 dated 3.12.2014 in which petitioner has been granted regular bail by a co-ordinate bench of this Court vide order dated 23.3.2015,

Patna High Court CR. MISC. No.15002 of 2023(2) dt.16-05-2023 2/2 passed in Cr.Mis.No. 11366 of 2015 (annexure 2). Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Aurangabad in Complaint Case No. 800/2014, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
