JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, this petitioner along with co-accused, Prakash Kumar, and 6-7 unknown persons came and abused the informant and on protest all the accused persons are alleged to have fired as a result of which son of informant received gun shot injury in his right hand.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Allegation of firing is general and omnibus. Petitioner was not apprehended on the spot and no incriminating article has
Patna High Court CR. MISC. No.12946 of 2022(3) dt.16-05-2022 2/2 been recovered from his possession. Petitioner claims clean antecedent and is in custody since 07.08.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-15, Muzaffarpur in connection with Muzaffarpur Sadar PS case No. 525/2020.
