Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code.
The petitioner is suspected to have committed murder of his sister as honour killing for the reason that the victim was pregnant from some co-villager. The aforesaid suspicion is supported by the confessional statement of the petitioner before the police while in police custody.
Submission of the petitioner is that the case diary would reveal that there is no other material against the petitioner to substantiate the aforesaid suspicion and confession before the police is no evidence.
Patna High Court Cr.Misc. No.17311 of 2017 (3) dt.17-05-2017 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Darbhanga/successor Court in connection with Bahadurpur (Sonki) Police Station Case No. 448 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
