In this case, the petitioner is seeking bail in connection with Suryagarha P.S. Case No. 149 of 2019 registered for offences under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, the victim was taken away by the petitioner and his associate Malik Yadav for selection of bride but, thereafter, he was found dead in the hospital. Perused the Case Diary which shows that the present petitioner along with one Malik Yadav have killed the deceased as one Sujit Mahto had had illicit relationship with Poonam Devi, the wife of the deceased.

Patna High Court CR. MISC. No.9712 of 2020(5) dt.11-09-2020 2/2 This Court has already rejected the prayer for bail of the co-accused, namely, Malik Yadav vide order dated 3.6.2020 passed in Cr. Misc. No. 8225 of 2020. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected.
