The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307, 379, 504 of the Indian Penal Code.

It is alleged that petitioner no. 1 assaulted with farsha on the head of Jahan Ara, wife of the informant, whereas petitioner no. 2 assaulted with sickle to Bibi Majra.

It is submitted by the learned counsel for the petitioners that the injury of injured persons have been found to be simple in nature caused by hard and blunt substance, whereas accusation is making assault by

Patna High Court Cr.Misc. No.10498 of 2015 (2) dt.13-03-2015 sharp cutting weapon. Statement has been made in para3 of the petition that petitioners have no criminal antecedent.

Considering the fact that the accusation has been levelled in the background of land dispute, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Pranpur (Roshna O.P.) P.S. Case No. 01 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
