JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner, who is in custody since 08.12.2019, seeks bail in connection with Kopa P.S. Case No. 204 of 2019, dated 02.12.2019 instituted for the offences under Sections 272, 273 and 120 (B) of the Indian Penal Code as well as Section 30 (a) of Bihar Prohibition and Excise Amendment Act, 2016.

Though 5382.720 litres of liquor is said to have been recovered from a truck which was seized by the police but the petitioner has not been named nor any suspicion was raised against him. One Hari Om Shah @ Hari Om Kumar is said to have named the petitioner at a

Aforesaid Hari Om Shah has been granted bail by a bench of this Court vide order dated 07.01.2020 passed in Criminal Miscellaneous No. 85467 of 2019. The petitioner has clean antecedents.

Considering the aforestated facts, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Saran in connection with Kopa P.S. Case No. 204 of 2019.
