JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/498/504/506/34 of the Indian Penal Code.

It is alleged that the informant was introduced with coaccused Santosh Kumar @ Santosh Kumar Mandal by her neighbor Rajo Mandal and Bhumia Devi. Subsequently, Santosh Kumar @ Santosh Kumar Mandal, on promise of marriage, established physical relationship with the informant. It is also alleged that this petitioner and co-accused Santosh Kumar @ Santosh Kumar Mandal demanded Rs.2,00,000/- (two lakhs) as dowry from the informant consequently mother of the informant paid Rs.20,000/- (twenty thousand) to them.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.10248 of 2015 (2) dt.23-04-2015 2/2 the informant has compromised the issue with co-accused Santosh Kumar @ Santosh Kumar Mandal as both got married. There is counter version of the occurrence also. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the thrust of accusation against co-accused Santosh Kumar @ Santosh Kumar Mandal, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No.223 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
