The petitioner seeks bail in connection with Madhubani Town P.S. Case No. 464 of 2019, registered under Sections 379 and 411 of the Indian Penal Code. Submission is that it would appear from the first information report that on the basis of the fardbeyan of informant, Md. Shahbaz Ali, Madhubani Town P.S. Case No. 464 of 2019 was instituted against unknown regarding theft of his motorcycle. In course of investigation, police recorded the confessional statement of Sikandar Kumar Yadav, who disclosed that one stolen motorcycle is handed over to the petitioner for sale, thereafter police raided the house of the petitioner from where one motorcycle, bearing registration no. BR-07U-7846,
Patna High Court CR. MISC. No.9942 of 2020(2) dt.29-02-2020 2/2 was recorded, which is not the stolen motorcycle of the present case. The petitioner is in custody since 13.12.2019 and he has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Madhubani Town P.S. Case No. 464 of 2019 to the satisfaction of the Chief Judicial Magistrate, Madhubani, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
