2. The petitioner is the widow of the Government Servant, who retired on 13.01.2010 as clerk under the Transport Department. She is getting pension as per submission of the learned counsel for the petitioner and has moved this Court raising a claim for benefits under the 'Assured Career Progression Scheme' (ACP) scheme.

3. It is submitted that the petitioner has filed a

Patna High Court CWJC No.2788 of 2023(2) dt.19-07-2023 2/2 representation spelling-out the details of her grievance before the District Transport Officer (respondent no. 9) on 07.02.2022 (Annexure 2).

4. Learned counsel submits that till date the claim has not been considered. Having regard to the submission, since the issue is yet to be considered by the respondent no. 9 pendency of the writ application would not serve any purpose.

5. Writ petition is accordingly disposed of, but with a direction to respondent no. 9 to pass orders on the petitioner's claim with reference to the service history of her husband and ensure payment of dues found admissible.

6. The entire exercise is required to be completed within 3 months from the date of submission of a copy of this order.

7. The writ petition is disposed of.
