1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Amas P.S. Case no. 334 of 2023 registered under sections 379, 413, 414, 401, 467 and 418 of the Indian Penal Code.
3. As per the prosecution case, the informant states that seeing the police personnel on patrol duty, two persons started to flee away on the motorcycle, however their motorcycle skidded as a result of which they fell down. Both of them were caught. On further enquiry, the accused who were caught disclosed that they were involved in sale of liquor along with other accused persons which included the petitioner herein as also one Pankaj Kumar.

4. Learned counsel for the petitioner submits that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The only material against him is the statement of co-accused made before police. The case of the petitioner stands of a similar footing to that of co-accused Pankaj Kumar who has been enlarged on anticipatory bail vide order dated 13.9.2024 passed in Cr. Misc. no. 58140 of 2024. The petitioner has no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., no incriminating article having been recovered from the petitioner's possession, the petitioner not having been arrested at the spot, grant of bail to similarly situated co-accused vide aforesaid order dated 13.9.2024 and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Amas P.S. Case no. 334 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
