JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Motipur P.S. Case No. 49/2017, registered under Sections 30(a) and 37(a) of Bihar Excise Act, 2016.

The accusation is of recovery of 35 bottles, each containing 750ml., Indian made foreign liquor from the house of the petitioners.

Submission is that both the petitioners are father and son and they are in custody since 01.03.2017. Having regard to the facts and the circumstances of the case, the petitioners Rajan Sah and Sanjay Sah, above named,

Patna High Court Cr.Misc. No.17629 of 2017 (2) dt.04-05-2017 are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (West) Muzaffarpur in connection with Motipur P.S. Case no. 49/2017.
