2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 324, 302, 504/34 of the Indian Penal Code.
3. According to F.I.R., on 28.12.23 at about 4 PM, all the F.I.R. named accused persons assaulted the grandson of informant by means of knife, lathi and danda as a result of which he died during course of the treatment.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As per F.I.R., it was co-accused Awadh Kishor Paswan and Shivam Kumar who inflicted knife injury to the deceased. So far this petitioner is concerned, allegation against him is general and

It is further submitted that similarly situated coaccused, namely, Saurabh Kumar has already been granted anticipatory bail by this Hon'ble Court vide order dated 27.09.2024 passed in Cr. Misc. No. 67262 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sitamarhi in connection with Suppi P. S. Case No. 315 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
