The petitioners apprehend their arrest in Vaishali P.S. Case No. 104 of 2012, registered for the offences punishable under Sections 417, 406 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act.
The complainant alleged that the marriage of his daughter was settled with Sohan Sahani petitioner no. 2 and engagement was also performed. But, later on the petitioners put further demand and due to non-fulfillment, the settled marriage was broken.
Learned counsel for the petitioners submits that no photographs and chit of paper showing the settlement of marriage and engagement is annexed to the complaint petition. It is further
Patna High Court Cr.Misc. No.6202 of 2015 (2) dt.04-05-2015 2/2 submitted that marriage of petitioner no. 2 as well as marriage of daughter of the informant have already been solemnized at different places.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 104 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
