JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Three hundred bags of rice each containing 45 Kg total weighing 132.75 quintals were recovered from a truck when the truck driver suggested that he was taking the rice for the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is not a PDS dealer rather petitioner is grain dealer. Admittedly recovery has not been made from the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.7311 of 2016 (2) dt.18-02-2016 2/2 before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Panapur P.S. Case No. 01 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
